About Child Custody in Washington

In the state of Washington, the best interests of the child is the primary factor considered in the determination of custody. However, the court will also consider the desires of the parents, the housing situation and other factors that may affect the child’s welfare. Typically the Washington Courts determine which parent is the primary parent which results in the children spending more than 50% of the time with the primary parent. However, the court’s determination of the residential schedule or parenting plan is based on the unique set of facts and circumstances in each individual case.

Child Custody Modifications

If circumstances relevant to child custody change, either parent may request a modification to the current custody agreement. Modifications may be granted if both parties agree or if the court rules that the modification is warranted by a legally significant substantial change in circumstances such that the modification would be in the best interest of the child.
